The right to teach at university is a distinctive philosophical and legal conundrum but a largely unexplored question. Drawing on Humboltdian principles, the legitimacy of the university teacher stems from their continuing engagement in research rather than possession of academic and teaching qualifications alone. This means that the right to teach needs to be understood as a privilege and implies that it is always provisional, requiring an ongoing commitment to research. Yet, massification of higher education systems internationally has led to (...) the disaggregation of the academic profession with teaching-only positions now increasingly common. University teachers employed to both teach and research face a narrowing set of performative expectations with respect to how ‘research-active’ is defined. This paper challenges these contemporary understandings and, drawing on historical evidence, argues that a broader definition of research and scholarship needs to underpin the basis of the right to teach. After decades of deregulation and innovation, contemporary financial markets remain firmly anchored in law and legal institutions. The idea that private financial actors simply want to escape government oversight and regulation is simplistic as private interests find the coercive powers of the state too useful to forgo. Instead, such actors engage law selectively to create a more certain environment for themselves and their profit-seeking activities. Contract law adds certainty to financial transactions; law shapes how financial actors use information and exploit (...) information technology; law constitutes financial values; and law allows financial institutions to be turned into assets. Law’s application is shaped by changing conceptions of risk, as well as by new business models for financial institutions. (shrink)

Money undergirds market exchange, but the social significance of money goes well beyond the obvious importance of its highly uneven distribution in modern market economies. In addition, modern money imposes an ostensibly precise and unidimensional valuation on social products, processes and relations that often conflicts with other modes of social valuation. In this regard, monetarization is a particular instance of quantification. Money’s status as an official economic metric is the result of a long, contingent, and uneven historical process. Given alternative (...) forms of valuation, people manage and constrain the commensurability of money through a variety of individual, institutional and organizational practices. The social reception of money is active, not passive. A variety of examples are discussed to illustrate and develop these points. (shrink)

We highlight exclusionary practices in management research, and demonstrate through example how a more inclusive management literature can address the unique contexts of persons with disabilities, a group that is disadvantaged in society, globally. Drawing from social psychology, disability, self-employment, entrepreneurship, and vocational rehabilitation literatures, we develop and test a holistic model that demonstrates how persons with disabilities might attain meaningful work and improved self-image via self-employment, thus accessing some of the economic and social-psychological benefits often unavailable to them due (...) to organizational-employment barriers. Our longitudinal study provides evidence of the self-image value of ‘doing’ in self-employment, highlighting the potential to reduce stigma and improve generalized self-efficacy and self-esteem. Implications for self-image theory, entrepreneurship training and development, and public policy related to persons with disabilities are discussed. (shrink)

Being Indigenous and operating in an institution such as a university places us in a complex position. The premise of decolonizing history, literature, curriculum, and thought in general creates a tenuous space for Indigenous and non-Indigenous peoples to confront a shared colonial condition. What does decolonization mean for Indigenous peoples? Is decolonization an implied promise to squash the tropes of coloniality? Or is it a way for non-Indigenous people to create another paradigm or site for their own resistance or transgression (...) of thinking? What are the roles of Indigenous and non-Indigenous peoples in this space of educational potential, this curriculum called decolonization? This article presents a multi-vocal reflection on these and related questions. (shrink)

This paper elaborates three approaches to the issue of state autonomy, and uses two empirical cases (British and American treasury policy during the 1930s) to illustrate them. The three approaches are the group affiliations approach, which considers the social characteristics of the individuals who work in an organization; the structural dependance approach, which considers the structural position of the organization within a network of resource flows; and a cultural approach, which considers the role of ideology in the determination of organizational (...) autonomy. The application of these three approaches to the two cases gives some support to all three, but the cultural approach proves especially useful in conjunction with the other two. (shrink)

We describe the ethics consultation service (ECS) at the Cleveland Clinic and report on its activities over a 24-month period in which 478 consultations were performed. To our knowledge, this is the largest case series of ethics consultations reported to date. Established more than 25 years ago, the ECS at the Cleveland Clinic is staffed by multiple consultants with advanced training in bioethics. Several of these ethicists work closely with specialized clinical units and research departments, where they participate in multidisciplinary (...) meetings and provide specialized assistance. This combination of historical experience, large numbers of consultation requests, and specialized clinical ethicists suggests that the experience at the Cleveland Clinic may be helpful to ethicists and others who may be considering how to structure and sustain a vibrant ECS. Our results highlight the diversity of activities performed by a high-volume ECS at a tertiary care facility. Our hope in sharing the inner workings of the ECS at the Cleveland Clinic is to promote dialogue on common practices and approaches across medical institutions that support ethics consultation. How does a social enterprise pursue its ethical mandate of social impact growth while navigating the perils of the most vulnerable stage in a venture’s life—scaling up? We observe a small inclusivity social enterprise attempting to scale up rapidly to create equality for people with disabilities throughout the world. Our embedded, ethnographic study is terminated with the venture’s unfortunate demise after their dramatic effort to scale up failed. By examining scaling decision-making and conflicts around creation reasoning longitudinally, our study identifies (...) over-use of effectual logic—a creation reasoning type considered more ethical and more appropriate for high-innovativeness contexts than causal logic—as a major factor in the venture’s failure. From this insight, we extend the parameters of effectuation theory to scaling up and dimensionalize its ethical implications. Guidance for social entrepreneurs to scale up successfully while maintaining ethical integrity is also provided. (shrink)

It is generally accepted that appropriate documentation of activities and recommendations of ethics consultants in patients’ medical records is critical. Despite this acceptance, the bioethics literature is largely devoid of guidance on key elements of an ethics chart note, the degree of specificity that it should contain, and its stylistic tenor. We aim to provide guidance for a variety of persons engaged in clinical ethics consultation: new and seasoned ethics committee members who are new to ethics consultation, students and trainees (...) in clinical ethics, and those who have significant experience with ethics consultation so that they can reflect on their practice. Toward the goal of promoting quality charting practices in ethics consultations, we propose recommendations on a broad array of questions concerning clinical ethics consultation chart notes, including whether and when to write a chart note, and practical considerations for the tenor, purpose, and content of a chart note. Our broader aim is to promote discussion about good charting practices in clinical ethics, with the hope of contributing to clear standards of excellence in clinical ethics consultation. (shrink)

The clinical ethicist met with Ms. H to clarify what information she wants and does not want to know. First, she wants to receive any treatment that could prolong her life, regardless of how the treatment affects her ability to engage in activities of daily living. Second, she wants to be included in the decision‐making process as much as possible, as long as clinicians use only “positive” language. Ms. H considers the words “dying,” “chemotherapy,” “radiation,” and “cancer” to be “bad (...) words.” For conversations in which these words cannot be avoided, she wants her clinicians to talk to her son. Her desired engagement includes hearing about risks, benefits, and alternatives to treatments if clinicians use only “positive” language. Finally, she says that she rarely sees doctors and that she is “very scared” of hospitals, despite exhibiting a comfortable demeanor.Should clinicians honor Ms. H's waiver of specified information and, if so, to what degree? _Yanomami_ raises questions central to the field of anthropology—questions concerning the practice of fieldwork, the production of knowledge, and anthropology's intellectual and ethical vision of itself. Using the Yanomami controversy—one of anthropology's most famous and explosive imbroglios—as its starting point, this book draws readers into not only reflecting on but refashioning the very heart and soul of the discipline. It is both the most up-to-date and thorough public discussion of the Yanomami controversy available and an innovative and searching assessment of (...) the current state of anthropology. The Yanomami controversy came to public attention through the publication of Patrick Tierney's best-selling book, _Darkness in El Dorado,_ in which he accuses James Neel, a prominent geneticist who belonged to the National Academy of Sciences, as well as Napoleon Chagnon, whose introductory text on the Yanomami is perhaps the best-selling anthropological monograph of all time, of serious human rights violations. This book identifies the ethical dilemmas of the controversy and raises deeper, structural questions about the discipline. A portion of the book is devoted to a unique roundtable in which important scholars on different sides of the issues debate back and forth with each other. This format draws readers into deciding, for themselves, where they stand on the controversy’s—and many of anthropology’s—central concerns. While valuable work has been done addressing clinical ethics within established healthcare systems, we anticipate that the projected growth in acquisitions of community hospitals and facilities by large tertiary hospitals will impact the field of clinical ethics and the day-to-day responsibilities of clinical ethicists in ways that have yet to be explored. Toward the goal of providing clinical ethicists guidance on a range of issues that they may encounter in the systematization process, we discuss key considerations and potential challenges in (...) implementing system-wide ethics consultation services. Specifically, we identify four models for organizing, developing, and enhancing ethics consultation activities within a system created through acquisitions: train-the-trainer, local capacity-building, circuit-riding, and consolidated accountability. We note each model’s benefits and challenges. To our knowledge, this is the first paper to consider the broader landscape of issues affected by consolidation. We anticipate that clinical ethicists, volunteer consultants, and hospital administrators will benefit from our recommendations. (shrink)

One powerful argument for dualism is provided by Chalmers: the ‘zombie’ or conceivability argument. This paper aims to establish that if one adopts the ‘Powerful Qualities’ account of properties developed by Martin and Heil, this argument can be resisted at the first premise: the claim that zombies are conceivable is, by the lights of Chalmers’ own account of conceivability, false. The Powerful Qualities account is outlined. Chalmers’ argument, and several distinctions which underlie it, are explained. It is argued that (...) to make sense of the claim that zombies are conceivable, some account of properties must be given. The paper’s central claim is presented and defended from potential responses: given the Powerful Qualities view, zombies are in fact inconceivable. Finally, an error theory is presented, which offers an explanation of why so many have taken the conceivability of zombies to be unproblematic, and the view is briefly contrasted with Russellian monism. This introduction to the Common Knowledge symposium titled “Comparative Relativism” outlines a variety of intellectual contexts where placing the unlikely companion terms comparison and relativism in conjunction offers analytical purchase. If comparison, in the most general sense, involves the investigation of discrete contexts in order to elucidate their similarities and differences, then relativism, as a tendency, stance, or working method, usually involves the assumption that contexts exhibit, or may exhibit, radically different, incomparable, or incommensurable traits. Comparative studies are required to (...) treat their objects as alike, at least in some crucial respects; relativism indicates the limits of this practice. Jensen argues that this seeming paradox is productive, as he moves across contexts, from Lévi-Strauss's analysis of comparison as an anthropological method to Peter Galison's history of physics, and on to the anthropological, philosophical, and historical examples offered in symposium contributions by Barbara Herrnstein Smith, Eduardo Viveiros de Castro, Marilyn Strathern, and Isabelle Stengers. Comparative relativism is understood by some to imply that relativism comes in various kinds and that these have multiple uses, functions, and effects, varying widely in different personal, historical, and institutional contexts that can be compared and contrasted. Comparative relativism is taken by others to encourage a “comparison of comparisons,” in order to relativize what different peoples—say, Western academics and Amerindian shamans—compare things “for.” Jensen concludes that what is compared and relativized in this symposium are the methods of comparison and relativization themselves. He ventures that the contributors all hope that treating these terms in juxtaposition may allow for new configurations of inquiry. (shrink)

The author proposes nothing less than the initiation of critical debate as to how Man’s openness to being implies his awareness of what is other than himself and leads ultimately to his consciousness of Being as Other. It is a discussion which boldly presents Buber as the (...) highest articulater of the existentialist phenomenology but leads up to and away from this summit with copious documentation and an admirable insight into its slow flowering in German intellectualism; it is a discussion which takes us from the foundation and quality of being through the theoretical implications of human experience to Buber’s supreme and decisive message: ‘Knowledge of Man presupposes knowledge of the absolute, the mystic, Thou’. Interpretation and politics merge in one the famous story of Joseph's power of dream interpretation in the Hebrew Bible. Rome's College of Augurs reinforces the entwinement of interpretation, power, religion, and folklore that one can also find in the earlier context of the Delphic Oracle. Augury reminds us that understanding happens in the context of an event, a context that presupposes one is missing something, lacking the necessary vision or foresight, and help is called for. Most of the contemporary scholars (...) who write about philosophical hermeneutics, the tradition which includes Martin Heidegger and Hans‐Georg Gadamer, are allergic to politics in the proletarian sense of that word. Party politics and parliamentarian procedures receive almost no attention in the secondary literature on contemporary hermeneutics. Assertion about the political incompetence of philosophy opens the door to an esoteric tradition in philosophy that includes Plato's “secret doctrine”, and stretches back to Pythagoras and Heraclitus. In Inhabiting the Earth Foltz undertakes the first sustained analysis of how Heidegger's thought can contribute to environmental ethics and to the more broadly conceived field of environmental philosophy. Through a comprehensive study of the status of "nature" and related concepts such as "earth" in the thought of Martin Heidegger, Foltz attempts to show how Heidegger's understanding of the natural environment and our relation to it offer a more promising basis for environmental philosophy than others that have so far (...) been put forward. Indeed, Dr. Foltz finds that to ecofeminism and social ecology, whose prescriptions are based on historically oriented etiologies of domination and oppression, Heidegger's work offers what is arguably the first comprehensive and nonreductive philosophy of history since Hegel that can embrace both nature and humanity in one narrative, and the first since Augustine that can do this while granting to nature a messure of selfstanding. But it is probably for the environmental philosophies of deep ecology, bioregionalism, and ecological holism that Heidegger's work has the most immediate, as well as the most extensive implications, because it is to them that it has the most affinity. Finally, as a corrective and a major challenge to deep ecology, which has tended to valorize the scientific approach to nature, Heidegger's work provides a sophisticated basis for showing the primacy of the poetic in the task of learning to inhabit the earth rightly. Through an examination of the thought of Martin Heidegger, I argue that the relation between human beings and the natural environment can be more radically comprehended by critically examining the character of the relation itself with regard to how it has been shaped and articulated by the tradition ofWestern metaphysics, particularly in light of the manner in which this tradition contains the central presuppositions of both modern natural science as weIl as contemporary technology. I conclude with an examination of (...) a “deconstructive analysis” of the concept of nature that has dominated Western philosophy; with a delineation of an alternative understanding of the environment, that is nevertheless deeply rooted in the Western tradition; and with a proposal that the present “environmental crisis” ultimately derives not from certain Judeo-Christian “values,” as it is commonly claimed, but from the initial metaphysical orientation of early Greek philosophy. We take our evenge upon the great, especialy upon great thinkers, by enlisting them for our own purposes, as our supporters and defenders in conflicts perhaps quite different from those in which they themselves were engaged. Aquinas was a master, virtually without peer, at the intellectual enlistment of the great, and he himself has been perhaps as widely and variously recruited as any of those to whom he devoted his own attentions. When we enlist Thomas for our own purposes with some consistency and success, the result is a " Thomism," of which there have been many, sometimes quite conflicting varieties. MARSHALL Roy, O.P., argue that as a piece of Thomism-as the enlistment of Thomas in defense and support of a particular contemporary view of truth, meaning, and epistemic justification-it is at best unpromising. In so doing, they indicate, at least in part, what views on these matters they think Thomas can plausibly be enlisted to support, that is, the sort of Thomism they find more convincing. Great thinkers are not, however, defenseless against our efforts to recruit them for our ends. Especially in the case of one whose thought is as ramified, precise, and historically distant as is that of Thomas Aquinas, these efforts are likely to meet with some resistance. This paper, the first of mine to be published, criticizes some arguments against the logical (i.e., metaphysical) possibility that there is incorrigible knoweledge of the external world.

Self-knowledge presents a challenge for naturalistic theories of mind. Peter Carruthers’s (2011) approach to this challenge is Rylean: He argues that we know our own propositional attitudes because we (unconsciously) interpret ourselves, just as we have to interpret others in order to know theirs’. An alternative approach, opposed by Carruthers, is to argue that we do have a special access to our own beliefs, but that this is a natural consequence of our reasoning capacity. This is the approach (...) of transparency theories of self-knowledge, neatly encapsulated in Byrne’s epistemic rule (BEL): If p, believe that you believe that p (Byrne 2005). In this paper, I examine an objection to Carruthers’s theory in order to see whether it opens up space for a transparency theory of self-knowledge: Is it not the case that in order to interpret someone I have to have some direct access to what I believe (cf. Oxford: Oxford University Press, 2011. xv + 400 pp. 2 black-and-white figs. Cloth, $160.This volume, according to its editor, is intended to fill the need for a companion to the Homeric Hymns, but “[it] is more than just a companion. It aims not only to evaluate the state of scholarship on the Hymns but also (...) to advance it” (23). Actually, the collection falls far short of a satisfactory companion, and its influence could set back scholarship on the Hymns to before Clay’s pioneering ensemble reading of the major Hymns in The Politics of Olympus (Princeton, 1989). Since the volume’s title promises “interpretative essays,” it might be ungenerous to dwell upon its shortcomings as a companion. But only a few of its fourteen contributions could even be described as “interpretative,” except loosely. Almost all focus upon putative facts, some of them imaginary.The editor’s introduction is symptomatic of problems that beset the entire collection. A survey of recent scholarship on the Hymns sketches representative positions of what is styled a “debate,” which to Faulkner apparently means that all views worth mentioning get equal time, none are ever legitimately invalidated, and consensus forms around a hypothetical middle ground. Faulkner divides the field into four categories, “Oral Poetics,” “Dating and Language,” “Performance and Function,” and “Genre, Panhellenism, and Local Connections,” a misleading division since a single research paradigm, traditional oral poetics, defines most of the issues here distributed among three of the categories (the first, third, and fourth). Faulkner’s historical sketch of oral poetics conventionally accords seminal status to Parry and Lord, but it takes no notice of Nagy, and an inexperienced reader would never suspect how much current work on archaic Greek poetry, including much in the present volume, emanates from this one scholar’s program. As for intellectual influences originating outside philology, Faulkner recognizes none at all; his survey makes no mention of structuralism, and more importantly, no mention of the functionalist sociolinguistics channeled into classical Greek scholarship by Gregory Nagy and (somewhat differently) by Claude Calame, both contributors to this very volume. On the other hand, Faulkner acknowledges the importance of Clay’s Politics quite explicitly, but still misleadingly, for he summarizes the book’s thesis but passes over the analytic framework on which (in principle) it rests. He then proceeds to tabulate a few dissenting positions, again without analyzing their premises or merits. All this conveys an impression that academic research on the Hymns has no programs, methods, or standards, that the [End Page 521] field consists of numerous independent researchers who spontaneously converge around a limited repertoire of questions, and that disciplinary authority belongs to a consensus of prudent experts rather than investigative rigor or hegemonic theory. From an editor who sees the academic landscape in this way, we get a collection of articles whose main purpose appears to be that of assembling and projecting consensus. In Evil and a Good God Bruce Reichenbach presents a theodicy for natural evil. According to Reichenbach, natural evil consists in suffering and pain and ‘states of affairs significantly disadvantageous to sentient beings’ which have either nonhuman causes or human causes for which no human being can be held morally responsible. He attempts to provide a morally sufficient reason why natural evil exists. In this paper I will evaluate this reason.
